EXPLANATION OF TERMS USED
Please read the terms and conditions before using this website. By continuing to access or use this website and the services offered, you signify your acceptance of these terms and conditions
1-EN DELIVERY  
is a company that provides express mail service in GTA and provides its services through its website www. endelivery.ca and is and is indicated by the words (“us”, “WE”, “our”, “the company”, or “the website”).
2- agreement
This means the agreement between the customer and EN Delivery Company to provide a service or services, by submitting an order through the website forms.
3- Receiver
 This means the person or entity identified in your request as the intended Receiver of your Shipment.
4- Delivery Address 
 This means the delivery address of the Shipment as defined via the EN Delivery website forms.
5- Shipment
 This means any goods that are transported under your request on our website for delivery may be transported by any means we choose.
6- Goods 
Means any products, items, documents, or packages.
7- Fragile Goods
 This means any inherently fragile goods, or have fragile components, that require special packaging and/or handling to ensure they are not damaged and such goods include, but are not limited to, electrical goods, glass, china, ceramics, pottery, and crockery. fossils, artifacts, artwork, or similar articles or merchandise.
8- DANGEROUS GOOD 
All shipments must be legal products, and not contain any dangerous goods. 
This includes but is not limited to:
A. Illegal drugs and/or any other illegal substances.
B. Explosives and/or fireworks, flammable materials.
C. Live animals.
D. Firearms, weapons, ammunition, or associated parts.
E. Biological and/or chemical materials and hazardous materials.
F. Compressed oxygen or other gases.
G. Flammable liquids including alcohol and flammable solids, such as nitrocellulose.
H. Infectious substances.
I. Oxidizing substances, such as ammonium dichromate or pool chlorine.
J. Radioactive materials.
K. Other goods that are not permitted by the applicable law to be sold or transported within the country.
We reserve the right to refuse any shipping It contains these goods.
9- Service or Services
 Means all the services that we provide to you through our website.
10- website forms 
Which indicates the details of the sender and receiver and the address of the pickup and drop-off that you chose to deliver with a description of the shipped goods and the price of the services provided and adding any notes regarding the shipment.
11-  Driver
EN Delivery contracts with the driver to pick up and deliver shipments.
The driver does not work for the company but works as an independent contractor.
The company is not responsible for him, and our responsibility to the driver and the customer is limited to receiving and delivering shipments.

ACCOUNT
Users may be natural or legal persons. To access our website, all users are required to register a personal profile. When registering, we may ask you, for the following information, but is not limited to.
The name, mobile phone number, and address, credit card information, email address, information about the geographical location issued by the user’s device, and other information about the user that may contribute to the verification process or provide the service.
1- The Service is available for use by persons at least 18 years of age, or the age of legal majority in your jurisdiction (if different than 18).
2- You agree to maintain the security and secrecy of your Account username and password at all times and not disclose it to anyone.
3- All account information is provided for use of the named account holder only, and not for any other person.
4- You are responsible for all activity that occurs under your Account, and any consequences of unauthorized access to your account.
5- We reserve the right to cancel or reject the account at any time without notice. 
6- It provides three types of accounts to suit all activities.
           1- Pharma account.
           2- Business account.
           3- Person account.

SERVICES
EN Delivery offers express door-to-door delivery during GTA.
For areas west of Toronto, we deliver on the same day of receiving the shipment, provided that it is received at the specified times.
For areas east of Toronto, we deliver the next day of receiving the shipment, provided that it is received at the specified times.
EN Delivery company provides iceboxes in all cars to keep fridge medicines. This service is only available to pharma accounts.
EN Delivery company provides service cash on delivery  ( COD) the company's drivers collect amounts from the receiver and the company keeps the amounts and delivers them to the sender on the next visit. This service is available to pharma accounts and business accounts.
 
Packaging and label
1- The shipment must be packed properly. Customer bears sole responsibility for any damage or loss arising from poor packaging and labeling of its belongings.
2- EN Delivery is not liable for any damage or loss arising from shipments that contain extra-fragile items for example, and not as a limitation Glass of all kinds, porcelain of all kinds, liquid supplies, mirrors, laptops, and mobile, However, the Customer allows arranging deliveries for such items but understand that they do so at their own risk. If the Customer decides to take this responsibility, we recommend using shatterproof materials, proper labeling and provide accurate details of shipment. Claims for such cases will be declined by EN Delivery.
3- As for the pharma account, all shipments sent to one address (even if it is to more than one person) must be placed in a big bag and one label should be placed.
4- For the pharma account, the refrigerator medicines should be placed in a separate bag from the rest of the medicines, with the explanation in the notes box. in the form on the website.
 
REFUSAL OF SERVICE :
EN Delivery reserve the right to refuse any package from you for the following reasons without liability to deliver the shipment on time.
This includes but is not limited to:
1. For any illegal content which is strictly prohibited such as Illegal drugs. Explosives and Firearms.
2. If any violation of federal, provincial law, or for fraudulent purposes.
3. A package having incomplete information.
4. The package contains dangerous goods.
5. Products that are improperly packaging or labeling.
6. Unpaid packages.
7. Any shipment or merchandise that does not meet our standard dimensions or weight permitted as specified in our Standard Operating Procedures or that otherwise requires special equipment or labor resources over one person to be loaded into or unloaded from our vehicles.
 
Undeliverable shipments
1- If the shipment is, or we consider it, unacceptable goods.
2- If the receiver cannot be reasonably identified or located.
3- If the receiver refuses to receive the shipment.

INSPECTION:
You agree that EN Delivery without any notice, at any time for any reason may, at our sole discretion, If we deem the shipment may be in opposition to stated Terms and Conditions that we may open any package or shipment to check the content of the shipment and ensure that it does not contain any unacceptable goods, and maintain the right to contact the proper authorities.
 
Rates – Payment
1- Fees and expenses for services are calculated concerning the terms and prices mentioned in the agreement.
2- The price is shown on the website. (including HST tax of 13%,)
3- Customers can add credit cards (Visa, MasterCard, American Express) and debit cards. During checkout, The customer gets a payment confirmation message to the email address registered in his file.     
4- One card will be always set as a default card by the system.
5- It is your responsibility to ensure that your credit card has a 
       sufficient balance to carry the costs of shipping your package.
6- We offer one invoice services which you will get bi-week.This feature is only available for the account pharma and business account and you agree to pay for the invoice in full within the applicable period.
7- For a personal account, All charges must be paid by the Customer in advance.
8- You are required to bring any dispute that you may have about billing to EN Delivery's attention no later than  (15) days after billing occurs.
9-  After this period has passed,  you will be deemed to have irrevocably accepted all such bills
10- The customer can see the instant prices based on the distance, weight, and volume entered in the field on the  EN Delivery website.
11- EN Delivery reserves the right to change the prices of the services at any time we deem necessary without prior notice.
12- You will always be primarily responsible for all delivery services charges. You will also be responsible for any costs we may incur in either returning your shipment to you or warehousing it pending disposition.
13- You must give us notice of any change to your name, e-mail address, or other circumstances that may affect the payment of any fees at least 15 days before the date of the change.

Monday to Friday   9:00 AM to 5:00 PM
Saturday                         9:00 AM to 3:00 PM
Working hours are the times in which shipments are received and delivered according to the specified and announced datesOur site works 24/7, however, we are not responsible for the unavailability of the service at any time and we will do our best to continue the service on our site.
We reserve the right to suspend access to our website, whether total or partial.

Limitation of Liability:
1- We will not be liable for any loss, delay, or damage, whether direct, indirect, or secondary, including but not limited to loss of profit or income, which may in any way occur as a result of a delivery error, non-delivery, or delay in delivery.
2- We will not be liable for loss, damage, or delay caused by events we cannot reasonably foresee or control which may expose employees and drivers to risks, including but not limited to acts of God, riots, and civil commotion. Risks, weather conditions, war, and defects inherent in goods (such as dangerous or fragile goods) or goods deemed unacceptable, lack of proper packaging or lack of labeling, and if the consignee refuses to take delivery of the shipment.
3- Without prior written consent, the compensation value for any insured shipment cannot exceed $50.
4- Submit a claim
We will not be liable for loss, delay, or damage to any packages unless notice specifying shipment details (sender, recipient, shipment number) is given 15 days after your shipment date.
5-  indemnification
You shall indemnify and hold us harmless from all liabilities, losses, claims, damages, expenses, and costs of any kind which we may incur as a result of our carriage of your shipment or your failure to comply with any regulation. Which you should note in connection with the transportation of shipped goods
6- We will not be liable for loss, damage, delay, or damage as a result of your use of our website or your inability to access our website for any reason.
7- We will not be liable for damages or losses resulting from loss or corruption of data
8- Viruses and other harmful content:
We do our best to prevent viruses or malware from being on our site. However, we do not guarantee that our site does not contain viruses or malware. We will not be responsible for any viruses or malware on our Site transmitted to your computer from our Site, or for any consequences that may result from the presence or operation of such software.
